This page informs you of the terms, conditions and fees for your usage of this Service.

In the following text ("us", "we", or "our") refers to the Party People website (the "Service", "Site").

You must read these terms carefully before complete your registration. By creating an account and using the Service, you agree to be bound by these terms and conditions.

1 Role and Obligations of Party People

1.1 Party People is a facilitator only, and our sole role is to assist communication between Party-Staff and Party-Organisers.

1.2 Party People does not employ Party-Staff.

1.3 All agreements for provision of services are made directly between Party-Organisers and Party-Staff; Party People is not a party to these argeements.

1.4 Party People does not make payments to Party-Staff, nor collect monies from Party-Organisers for this purpose. All fees charged by Party People are in consideration of the Services on this website relating to searching and communicating between Members.

1.5 All Party-Staff and Party-Organiser profiles as well as Party-Jobs on the Site are posted by third parties and not by us. We are not a staff or recruitment agency and we do not endorse or recommend any agency, company or individual that posts Party-Staff or Party-Jobs on our site. We do not verify the legitimacy, accuracy or currency of any profile or vacancy posted on our site.

2 All Member Obligations

2.1 You must, at all times, provide information and answer all questions honestly, correctly and completely including (but not limited to); when you create your account, upload images, list parties, send/cancel applications/invites/bookings, communicate in any form with other members; as well as when discussing any aspect of your experience on Party People with any third party.

2.2 You agree that any information you provide to Party People when you create your account or register the details of an event can be used by Party People in accordance with our Privacy Policy.

Party-Organisers and Party-Staff Agreements

2.3 Although Party People is not a party to the agreement between Party-Organisers and Party-Staff, we require that Party-Organisers and Party-Staff include at least the following terms into an independent written agreement between themselves.

  • 2.3i Date of the event.
  • 2.3ii The start and end time (or an indication of approximate expected duration).
  • 2.3iii The address at which the event will be held, and the Party-Staff is required to attend.
  • 2.3iv The nature of the event and the specific activities required to be performed by the Party-Staff.
  • 2.3v The rate of pay for the event (which must be equal to the amount referred to in the listing on the Party People website).
  • 2.3vi How and when payment will be made by the Party-Organiser to the Party-Staff.

3 Party-Staff Obligations

3.1 The following requirements, charges and obligations apply specifically and exclusively to Members registered as Party-Staff.

3.2 It is your responsibility to negotiate and agree the terms of your engagement with the Party-Organiser. You are also responsible for making your own inquiries of the Party-Organiser relating to the event for which the Party-Organiser needs staff, including checking the nature of the event and ensuring that you are comfortable with providing services at the event and that you consider you have the necessary experience and qualifications to provide the services. Party People does not conduct its own inquiry as to any of the information supplied by the Party-Organiser when they register with Party People or the details of any event listed and Party People will not be responsible if you do not find the Party-Organiser or the event suitable when you attend.

3.3 You understand that you may have certain legal obligations to the Party-Organiser or third parties including tax, professional/business registration and licencing requirements/obligations as well as potential compliance with laws relating to working with children. These are your obligations and Party People is not liable to you, the Party-Organiser or any third party if you do not meet these obligations.

3.4 You are required to pay a fee for the use or the cancellation of our Services, as follows:

4 Party-Organiser Obligations

4.1 The following requirements, charges and obligations apply specifically and exclusively to Members registered as Party-Organisers.

4.2 It is your responsibility to negotiate the terms of your engagement with the Party-Staff you choose. You are also responsible for making your own inquiries of the staff, checking references and making sure you consider they are suitable for you. Party People does not conduct its own inquiry as to any of the information supplied by Party-Staff when they register with Party People and Party People will not be responsible if you do not find the Party-Staff suitable or if they do not have the qualifications or experience as represented by them on the Party People website.

4.3 You understand that you may have certain legal obligations to Party-Staff or third parties including insurance, workers’ compensation, payment of award rates, tax obligations and compliance with laws relating to working with children. These are your obligations and Party People is not liable to you, the staff or any third party if you do not meet these obligations.

4.4 You are required to pay a fee for the use or the cancellation of our Services, as follows:

4.5 We reserve the right to vary these fees at any time.

5 Termination

5.1 Party People may terminate this agreement immediately on giving you notice if you breach any term of this agreement. If Party People terminates this agreement, we will also communicate the fact of this termination to any Member with whom you have an active invite, application or booking.

5.1A If you are a Party-Organiser, we will notify any Party-Staff who you have booked for a Party-Job. It will then be the sole responsibility of the other Party-Staff to independently decide whether they will continue to work for you under the terms of the separate agreement you entered into with them.

5.1B If you are a Party-Staff, we will notify any Party-Organisers who have booked you for a Party-Job. It will then be the sole responsibility of the other Party-Organiser to independently decide whether they will continue to hire you under the terms of the separate agreement you entered into with them.

6 Liability

6.1 Except as expressly set out in this agreement, and subject to any terms, guarantees, warranties or conditions that by law may not be excluded, all representations conditions, guarantees, warranties, terms and obligations implied by law or otherwise relating to the services provided by Party People under this agreement are excluded.

6.2 To the extent permitted by applicable law, Party People will not be liable for any special, indirect or consequential loss or damage (including personal injury), loss of profit or opportunity arising out of or in connection with the services provided by Party People, including as a result of not being able to obtain staff, whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.

6.3 To the maximum extent permitted by law, the aggregate liability of Party People under or in relation to this agreement (including indemnities) arising out of all or any act, omission or event or series of related acts, omissions or events will not exceed the direct cost monetary value of the services provided by Party People to you and which directly led to Party People’s liability arising.

7 General Terms

7.1 If part or all of any of these Terms is illegal or unenforceable it will be severed from the other Terms and will not affect the continued operation of the remaining provisions of the other Terms.

7.2 This agreement can only be amended, supplemented or waived in writing signed, by both parties. The failure of either party to enforce, or the delay by either party in enforcing, any of its rights shall not be deemed a continuing waiver or a modification of this agreement.

7.3 This agreement contains the entire agreement of the parties with respect to its subject matter.
